1. Acceptance of Terms

By downloading, installing, or using Waterful ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Waterful is a hydration tracking application for iOS that helps users monitor their daily water intake, set hydration goals, and receive personalized reminders. The App may integrate with Apple Health to read and write hydration-related health data.

3. User Accounts

You may create an account using Sign in with Apple. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscriptions and Payments

Waterful offers a free tier with core features and a Pro subscription with additional features. Subscriptions are billed through your Apple ID account and automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your device's Settings under Subscriptions.

5. Health Data Disclaimer

Waterful is not a medical device and does not provide medical advice. The hydration recommendations and scores provided by the App are for informational purposes only and should not replace professional medical guidance. Always consult with a healthcare provider regarding your hydration needs, especially if you have medical conditions.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or infrastructure
• Impersonate any person or entity when using the App
• Use automated systems to access the App in a manner that exceeds reasonable usage

7. Intellectual Property

All content, design, graphics, and code within Waterful are owned by Waterful and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, Waterful and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or in connection with your use of the App.

10. Modifications

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Waterful operates, without regard to conflict of law provisions.
